- چکیده
- پژوهش حاضر با هدف تبیین حقوق مهاجران از منظر تطبیقی در فقه امامیه و حقوق بینالملل انجام شده است. روش تحقیق در این نوشتار توصیفی-تحلیلی و ابزار گردآوری اطلاعات کتابخانهای با تکیه بر منابع نقلی (آیات، روایات و فتاوا) است. یافتههای تحقیق نشان میدهد که اگرچه هر دو نظام حقوقی بر اصولی بنیادین همچون کرامت انسانی، عدالت و حمایت از مظلوم اشتراک نظر دارند، اما در مبانی نظری (خاستگاه الهی در برابر خاستگاه بشری) و دامنهی شمول احکام تفاوتهای معناداری میان آنها وجود دارد. در حالی که حقوق بینالملل بر اساس اسناد جهانی به دنبال ایجاد چارچوبی سکولار و مطلق برای حقوق مهاجران است، فقه امامیه با بهرهگیری از مفاهیمی چون عقد ذمه، امان و قاعدهی نفی سبیل، ضمن بهرسمیت شناختن حقوق بنیادینِ زیستی و مدنی مهاجران، احکام آنان را در تناسب با شرایط جامعهی اسلامی و مصالح نظام تنظیم میکند. در نهایت، پژوهش نتیجه میگیرد که با وجود تفاوت در منابع استنباط و رویکردهای اجرایی، پتانسیل همگرایی میان این دو مکتب در راستای ارتقای امنیت و کرامت مهاجران وجود دارد و میتوان با بهرهگیری از ظرفیتهای فقهی در کنار چارچوبهای بینالمللی، به راهکارهای موثرتری برای حمایت از این گروه دست یافت.
- Abstract
- This research aims to explain the rights of migrants from a comparative perspective in Imami jurisprudence and international law. The methodology of this research is descriptive-analytical, and the data collection method is library research, relying on textual sources (Quranic verses, hadiths, and legal fatwas). The findings indicate that although both legal systems share fundamental principles such as human dignity, justice, and support for the oppressed, there are significant differences between them regarding theoretical foundations (divine origin versus human origin) and the scope of rulings. While international law seeks to create a secular and absolute framework for migrants' rights based on global documents, Imami jurisprudence, by utilizing concepts such as the Dhimma contract, Aman (safe conduct), and the rule of Nafi Sabil (denial of domination), while recognizing the fundamental biological and civil rights of migrants, regulates their rulings in proportion to the conditions of the Islamic society and the interests of the system. Finally, the research concludes that despite differences in sources of inference and executive approaches, there is a potential for convergence between these two schools of thought in order to promote the security and dignity of migrants; by utilizing jurisprudential capacities alongside international frameworks, more effective solutions can be achieved to support this group.
