    چکیده
      این پایان‌نامه با هدف بررسی و امکان‌سنجی مسئولیت مدنی دولت ناشی از فیلترینگ اینترنتی در ایران انجام شده است. در این پژوهش، نقش کمیته تعیین مصادیق محتوای مجرمانه و شورای عالی فضای مجازی به عنوان مراجع قانونی تصمیم‌گیر در حوزه فیلترینگ به‌صورت دقیق مورد تحلیل قرار گرفته است. پژوهش حاضر با به‌کارگیری روش توصیفی–تحلیلی، به بررسی منابع قانونی مرتبط پرداخته و شرایط تحقق مسئولیت مدنی دولت، معیارهای تشخیص تقصیر یا خطر، و حدود تعهدات قانونی نهادهای ذی‌ربط را تبیین می‌کند یافته‌های تحقیق نشان می‌دهد که فیلترینگ در فضای مجازی، به عنوان ابزاری برای کنترل و نظارت بر جریان آزاد اطلاعات، از سوی نهادهای حاکمیتی مانند شورای عالی فضای مجازی و کمیته تعیین مصادیق محتوای مجرمانه اعمال می‌شود. هرچند هدف اعلامی این سیاست‌ها صیانت از امنیت ملی و اخلاق عمومی است، اما در عمل، فیلترینگ گسترده آثار منفی و بعضاً زیانباری بر حقوق اساسی شهروندان، فعالیت کسب‌وکارهای اینترنتی و جریان آزاد اطلاعات بر جای گذاشته است.از منظر حقوقی، محدود ساختن دسترسی آزاد به اطلاعات و جلوگیری از فعالیت‌های قانونی در بسترهای دیجیتال می‌تواند موجب بروز خسارات مستقیم و غیرمستقیم به اشخاص حقیقی و حقوقی شود؛ از جمله کاهش درآمد، از بین رفتن سرمایه‌گذاری، محدود شدن رقابت و تضعیف اعتماد اقتصادی. درچنین شرایطی، بحث مسئولیت مدنی دولت ناشی از تصمیمات نهادهای حاکمیتی در زمینه فیلترینگ مطرح می‌شود. نبود شفافیت در تقسیم وظایف، فقدان نظام پاسخگویی مؤثر و عدم امکان اقامه دعوای مدنی علیه تصمیمات این نهادها، سبب شده است تا حقوق زیان‌دیدگان در عمل قابل استیفا نباشد.
    Abstract
      This thesis aims to examine and assess the possibility of the government's civil liability arising from internet filtering in Iran. The study provides a detailed analysis of the roles of the Committee for Determining Instances of Criminal Content and the Supreme Council of Cyberspace as the principal legal decision-making bodies in the field of filtering. Using a descriptive–analytical method, the research explores relevant legal sources and clarifies the conditions for establishing governmental civil liability, the criteria for identifying fault or risk, and the scope of legal obligations of the relevant institutions.The findings indicate that internet filtering, as a tool for controlling and monitoring the free flow of information, is implemented by governmental bodies such as the Supreme Council of Cyberspace and the Committee for Determining Instances of Criminal Content. Although the declared objective of these policies is to safeguard national security and public morality, in practice, extensive filtering has led to negative and sometimes harmful consequences for fundamental rights of citizens, online businesses, and the free flow of information. From a legal perspective, restricting access to information and hindering lawful activities in digital platforms may result in both direct and indirect damages to individuals and legal entities, including loss of income, destruction of investments, reduced competition, and weakening of economic trust. Under such circumstances, the issue of government civil liability arising from the decisions of sovereign bodies in the field of filtering becomes significant. The lack of tra  arency in the distribution of responsibilities, the absence of an effective accountability system, and the inability to bring civil claims against the decisions of these institutions have, in practice, prevented affected parties from obtaining redress.The results of this study suggest that the Iranian legal system requires the development of a clear and comprehensive framework for determining civil liability arising from sovereign decisions in cyberspace, in order to more fairly balance the conflict between public interest and private rights of citizens.
