    چکیده:


    پژوهش حاضر به بررسی وضعیت حقوقی قانونی‌سازی

    استعمال کانابیس در پرتو حقوق بین‌الملل و تعهدات ناشی از کنوانسیون‌های سه‌گانه مواد مخدر سازمان ملل یعنی کنوانسیون واحد مواد مخدر ۱۹۶۱، کنوانسیون مواد روان گردان ۱۹۷۱، کنوانسیون مبارزه با قاچاق غیر قانونی مواد مخدر و روان گردان ۱۹۸۸ می‌پردازد. مسئله اصلی پژوهش، تعارض آشکار میان ممنوعیت استعمال غیرپزشکی کانابیس در اسناد بین‌المللی و رویه عملی برخی دولت‌ها از جمله کانادا، برخی ایالات آمریکا، هلند و اروگوئه است. فرضیه پژوهش بر این اساس است که این اقدامات نقض صریح تعهدات معاهداتی است، با این حال، عدم اعتراض مؤثر سایر دولت‌های عضو ممکن است نشانگر شکل‌گیری یک عرف جدید بین‌المللی باشد.

    روش گردآوری داده‌ها، کتابخانه‌ای و مبتنی بر بررسی پژوهش‌های علمی، مقالات، یادداشت‌های تحلیلی، اسناد مصوب و رویه‌های دولتی و بین‌المللی است. داده‌ها با روش تحلیل منطقی و تحلیلی مورد بررسی قرار گرفته‌اند تا توازن میان تعهدات قراردادی و تحولات واقعی سیاست‌های ملی مشخص شود.

    یافته‌ها نشان می‌دهد که قانونی‌سازی استعمال غیرپزشکی کانابیس با تعهدات ماهوی دولت‌ها ذیل کنوانسیون‌های ????، ???? و ???? ناسازگار است. هرچند کنوانسیون‌ها در تعیین مجازات‌ها و ابزارهای اجرایی تا حدی انعطاف‌پذیری فراهم می‌کنند، این انعطاف شامل محدودیت‌های بنیادین ماده ? (ج) کنوانسیون ???? نمی‌شود. با این حال، تحلیل رویه دولت‌ها، سکوت سایر اعضای معاهدات و توجیهات حقوق بشری و سیاستی دولت‌های قانونی‌ساز، نشانگر آغاز روند تغییر در عرف بین‌المللی و شکل‌گیری یک رویه جدید است که ممکن است به نسخ ضمنی ممنوعیت پیشین منجر شود.

    در نهایت، پژوهش نتیجه می‌گیرد که حقوق بین‌الملل کنترل مواد مخدر در آستانه تحولی بنیادین قرار دارد و در آینده ممکن است نظامی نوین، مبتنی بر رویکردهای انسانی‌تر، واقع‌بینانه‌تر و سازگار با سیاست‌های ملی، جایگزین چارچوب سنتی ممنوعیت مطلق شود، با این حال تعارض میان تعهدات معاهداتی و رویه‌های داخلی تا تثبیت عرف جدید همچنان پابرجاست.

    Abstract

    Abstract

    The present study examines the legal status of the legalization
    of cannabis use in light of international law and the obligations arising from
    the United Nations’ three major drug control conventions, namely the ۱۹۶۱
    Single Convention on Narcotic Drugs, the ۱۹۷۱ Convention on Psychotropic
    Substances, and the ۱۹۸۸ United Nations Convention against Illicit Traffic in
    Narcotic Drugs and Psychotropic Substances. The central issue addressed in this
    research is the apparent conflict between the prohibition of non-medical
    cannabis use under international instruments and the domestic practices of
    certain States, including Canada, several states of the United States, the
    Netherlands, and Uruguay. The research hypothesis posits that such measures
    constitute a clear breach of treaty obligatio   nevertheless, the lack of
    effective objection by other States Parties may indicate the emergence of a new
    rule of customary international law.

    The data for this research have been collected through a
    library-based method, relying on the examination of scholarly works, academic
    articles, analytical commentaries, adopted instruments, and State and
    international practice. The data are analyzed using a logical and analytical
    approach in order to assess the balance between conventional obligations and
    the evolving realities of national drug policies.

    The findings demonstrate that the legalization of non-medical
    cannabis use is incompatible with the substantive obligations of States under
    the ۱۹۶۱, ۱۹۷۱, and ۱۹۸۸ Conventions. Although the conventions provide a degree
    of flexibility with respect to the determination of sanctions and enforcement
    mechanisms, such flexibility does not extend to the fundamental limitations
    enshrined in Article ۴(c) of the ۱۹۶۱ Convention. Nevertheless, an analysis of
    State practice, the silence of other treaty parties, and the human rights–based
    and policy justifications advanced by legalizing States suggests the initial
    stages of a shift in customary international law and the formation of a new
    practice that may ultimately lead to the implicit modification of the former
    prohibition.

    In conclusion, the study finds that the international drug
    control regime is at the threshold of a fundamental transformation. In the
    future, a new framework—based on more humane, pragmatic, and nationally
    adaptable approaches—may replace the traditional model of absolute prohibition.
    However, the tension between treaty obligations and domestic practices is
    likely to persist until such a new custom becomes firmly established.
